The petitioners apprehend their arrest in connection with Makhdumpur P.S. Case No.45 of 2015, registered for the offences punishable under Sections 147, 148, 149, 325, 326, 307 and 302 of the Indian Penal Code.
The petitioners along with other co-accused persons are said to have assaulted the brother-in-law (Devar) of the informant
Patna High Court CR. MISC. No.23624 of 2022(2) dt.30-08-2022 2/2 by means of various weapons on different parts of his body as a result of which, the brother-in-law of the (Devar) of the informant died. Petitioner No.1, Amresh Sharma is said to have assaulted Deenanath by means of Garasa on his head.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the allegations are general and omnibus. The FIR was lodged in the year 2015 and the petitioners were named in the FIR. It is submitted that some accused persons faced trial and they were acquitted (Sessions Trial No.286 of 2015/462 of 2015). Learned APP for the State opposes the prayer for anticipatory bail of the petitioners.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioners is rejected.
