JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 This application, for grant of anticipatory bail, arises out of Bachhwara No. 95 of 2018, disclosing offences under Sections 147, 148, 149, 120(B) and 302 of the Indian Penal Code and Section 27 of the Arms Act.
At the very outset, learned counsel appearing on behalf of the State has submitted that in this case process under Section 82 and 83 Cr.P.C. has already been exhausted against the petitioners, which is evident from para -51 of the supplementary case diary.
Learned counsel for the petitioners has submitted that petitioners are ladies and have falsely been made accused in this case and similarly situated co-accused of this case has already

Having heard both sides, in view of the fact that process under Section 82 and 83 Cr.P.C. has already been exhaused, I am not inclined to grant the privilege of anticipatory bail to the petitioners rather petitioners should move before the court below for grant of regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available on record and also after considering the submission of learned counsel for the petitioner, if possible on same day, without being prejudiced by the order of this Court.
