1. Heard Mr. Ajay Thakur, learned Advocate appearing on behalf of petitioners, learned APP for the State and learned counsel for the informant.

2. The petitioners apprehend their arrest in connection with Sahebganj P.S. Case no.242 of 2024 registered under Sections 302, 120B and 34 of the Indian Penal Code.

3. The allegation in the F.I.R is that sister of the informant who was married to one Kunal Kishore in the year 2008 was done to death by the husband and her family members including the petitioners herein.

4. It is submitted by learned counsel for the petitioners that petitioners are the sister and brother-in-law of the husband of the deceased. Prima facie, it would appear from the reading of the F.I.R itself that an information with regard to the fact that the deceased had fallen from the roof had been given to the informant on 10.05.2024 whereafter the informant also came to the place of occurrence on 11.05.2024 and found that the dead body was kept in the house. It has thus been submitted that there have been no effort on the part of the accused persons to cause disappearance of evidence. The names of the petitioners have only been taken on the basis of suspicion with no concrete evidence against them.

It is further submitted that materials collected during course of investigation also disclose that petitioners were residents of Muzaffarpur and they had arrived at the place of occurrence only after the incident had taken place. This fact has been supported by number of independent witnesses including the neighbors who have been examined during course of investigation. Further, it is also to be taken into consideration that the husband of the deceased Kunal Kishore is in custody since 20.12.2024 and charge-sheet has been submitted against him. The petitioners undertake to co-operate in the case/trial.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.

6. In view of the aforesaid facts and circumstances of the case and also considering the fact that husband who is primarily responsible for the welfare of his wife is in custody and petitioners are the married sister and her husband, it is directed that both the petitioners above named in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Sahebganj P.S. Case no.242 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Muzaffarpur West, Muzaffarpur, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
