This is a petition for grant of anticipatory bail for offence under Sections 420, 467, 468 and 471/34 of the Indian Penal Code and 3 of the Public Property Damage Act. On the land of Housing Board, a construction was going. Co-accused, Gautam Kumar, was arrested at the spot and the petitioner was suspected to be involved in the said construction.

Submission of the learned counsel for the petitioner is that the place of alleged occurrence was the ancestral land of the petitioner and just to put wrongful claim on that, false allegation is there.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each in connection with Rajiv Nagar P.S. Case No. 47 of 2017 to the satisfaction of

Patna High Court Cr.Misc. No.28745 of 2017 (2) dt.07-07-2017 2/2 the Additional Chief Judicial Magistrate, III, Patna, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
