JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner, who is the husband of the daughter of the complainant, is in custody in connection with C.R. Case No. 118 of 2017, T.R. No.1143 of 2020 for the offence under Section 498 A of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner would submit that similar allegation was levelled against the petitioner by the daughter of the complainant in Dalsinghsarai P.S. Case No. 343 of 2017 for the offences under Sections 341, 323, 504/34 and 498A of the Indian Penal Code. Petitioner is in

Patna High Court CR. MISC. No.25448 of 2020(2) dt.29-09-2020 2/2 custody since 17.02.2020.

Considering the fact that the petitioner is the husband of the daughter of the complainant/son-in-law of the complainant and the daughter of the complainant (wife of the petitioner) has filed similar case against the petitioner in connection with Dalsinghsarai P.S. Case No. 343 of 2017, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Dalsinghsarai in connection with C.R. Case No. 118 of 2017, T.R. No. 1143 of 2020.
