====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Falka (Pothia) P.S. Case No. 276 of 2018 instituted for the offence under Sections 363 and 366(A) of the Indian Penal Code.

In the written report it is alleged that informant used to live in Punjab with his family members. On 10.6.2018 the informant returned to his village for some work. He left his son and daughter in Punjab. The informant got information on 2.7.2018 from his brother that his daughter had gone outside the house for work and did not return. The informant learnt on 16.7.2018 that his daughter has been enticed by petitioner for the purpose of marriage.

Counsel for the petitioner submits that there was

Patna High Court Cr.Misc. No.72480 of 2018(2) dt.17-12-2018 2/2 love affairs between daughter of informant and petitioner. The victim girl has given statement under Section 164 Cr. P.C. wherein she has stated that she was living with her uncle and aunt in Punjab. Petitioner took her from Punjab to Katihar and established physical relationship with her. She started crying, then petitioner performed marriage with her. In this manner, the victim girl had voluntarily gone with this petitioner and established physical relationship with him.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st cum Special Judgte, Katihar, in connection with Falka (Pothia) P.S. Case No. 276 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioner.
