The petitioner seeks anticipatory bail in a case instituted for the offences under Sections 379 of the Indian Penal Code and Rule 40 of the Bihar Mines and Mineral Regulation and Development Rules, 1972.

Allegation has been made that petitioner is illegally running brick kiln and selling the earth without any licence causing loss to the Government.

Petitioner submits that he has valid document in running the kiln and has deposited required amount of fee. Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioners, namely, Vijay Kumar Yadav, be released on
