The petitioner seeks bail in Hajipur Sadar P.S. Case No. 508 of 2018, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that in course of search, one motorcycle rider turned his motorcycle after putting down two packet of bora on road and attempted to run away. The another rider has succeeded in fleeing away. It has further been alleged that police arrested one person who was sitting with this petitioner on motorcycle. He has disclosed the name of this petitioner. On search police recovered 100 litres country made liquor from two packet of bora.

Learned counsel for the petitioner has submitted that

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II-cum-Special Judge, Excise Act, Vaishali at Hajipur, in connection with Hajipur Sadar P.S. Case No. 508 of 2018. Both the bailors will be close relative of petitioner.

From paragraph 3 of bail petition, it appears that other case of Excise Act are also pending against him. The petitioner will file affidavit at the time of release that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities, his bail bond in the instant case will liable to be cancelled. (Sanjay Priya, J) khushbu/- U T
