The petitioners apprehend their arrest in Faser P.S. Case No. 45 of 2013, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The daughter of the deceased alleged that her father had only three daughters. Her uncle and grand-father wanted to grab the lands of her father, so that her father may not distribute the same among his daughters. Manoj Yadav, Satendra Yadav and Sanjay Yadav, the petitioners no. 1, 3 and 4 assaulted her father and kept him confined in a room consequently her father died. Learned counsel for the petitioners submits that Naresh Yadav died of his natural death. The doctor who held autopsy did
Patna High Court Cr.Misc. No.21859 of 2014 (5) dt.08-05-2015 2/2 not find any external or internal injury. The viscera report also not shows any poisonous substance.
Considering the facts aforesaid and the fact that the petitioners above named who are brothers and father of the deceased, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Faser P.S. Case No. 45 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
