The petitioner claims himself to be an ex-service man. It is averred that by virtue of being an ex-service man he is entitled to settlement of a government waste land for the purpose of agriculture or residence.

Indisputably, the government has offered to settle 0.37 decimals of land to the petitioner. The writ application has been filed for a direction upon the respondents to settle with him a particular piece of land detailed in para 1-(i). In the counter

Patna High Court CWJC No.4549 of 2013 (5) dt.28-01-2016 affidavit, said stand of the petitioner has been denied. The Court required the petitioner to bring on record any decision of the government which entitles the ex-service man like the petitioner to be settled with a land of his/their choice. No affidavit bringing on record any such decision of the Government in the concerned department/ ministry has been placed on record. In absence thereof, in my view, the writ application appears to be completely mis-placed/ mis-conceived.

It is, accordingly, dismissed.
