JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 23.06.2010 and the report of the learned trial court goes to show that up till now, trial of the petitioner could not be concluded. Furthermore, report of the trial court reveals that the case of the petitioner is still pending for recording the evidence of Investigating Officer and, therefore, it appears that there is no possibility of conclusion of the trial of the petitioner in near future.

No doubt, petitioner is said to be main assailant but no person can be detained in jail custody for an indefinite period in the name of trial.

Patna High Court Cr.Misc. No.28296 of 2016 (4) dt.07-09-2016 2/2 Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Nalanda at Biharsharif in connection with Session Trial No. 751 of 2010, arising out of Rajgir Muffasil ( Chhabilapur) P.S.Case No. 27 of 2010.
