Petitioner is in jail custody since 11.10.2014 in a case registered under section 302/34 of the Indian Penal Code on the accusation that he took the deceased from his house and later on, in the next morning, dead body of the deceased was recovered. Submission on behalf of the petitioner is that except suspicion, there is nothing against the petitioner. From perusal of the impugned order of the learned Addl. Sessions Judge III, Munger, it appears that up till now, case has not been committed to the court of sessions.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of
Patna High Court Cr.Misc. No.23757 of 2016 (3) dt.13-07-2016 the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Bariarpur P.S. Case no. 111/2014. However, it is made clear that if the case of the petitioner has not been committed to the court of sessions as yet, learned Sessions Judge, Munger shall ensure the commitment of the case of the petitioner to the court of sessions without any delay. shahid (Hemant Kumar Srivastava,J) U T
