JUSTICE SANDEEP KUMAR ORAL ORDER 24-01-2022 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bihpur (Jhandapur O.P.) Police Station Case No. 273 of 2020, disclosing offences under Section 30(a) and 38(1) of the Bihar Prohibition and Excise Act, 2018. It appears from the FIR that the recovery is not from the poultry farm of the petitioner but near the poultry farm of the petitioner.

Considering the aforesaid fact, the application for anticipatory bail is allowed.

Let the petitioners, named above, in the event of

No.33941 of 2021(2) dt.24-01-2022 2/2 their arrest or surrender before the Court below within ten weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Session Judge II-cum-Special Judge, Excise Act, Bhagalpur/Incharge Successor Court, in connection with Bihpur (Jhandapur O.P.) Police Station Case No. 273 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
