This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with K Hat (Maranga) PS Case No. 90 of 2018 for the alleged offence punishable under Sections 413 and 414 of the Indian Penal Code.

Earlier the petitioner was granted bail vide order dated 10.07.2018 in Cr. Misc. No. 41276 of 2018 but his release on bail was subject to verification of the antecedent. On verification, it transpired that there is one case pending against the petitioner and as such he was not released. Learned counsel for the petitioner submits that in the instant case there is allegation of recovery of two mobile phones from the

Patna High Court Cr.Misc. No.366 of 2019(2) dt.04-02-2019 2/2 possession of the petitioner. Learned counsel further submits that petitioner is in custody since 17.02.2018. Considering the period of incarceration, this application is allowed. Accordingly, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with K Hat (Marang) PS Case No. 90 of 2018.
