The petitioner apprehends his arrest in connection with Complaint Case No. 2282 of 2014, registered under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of torturing of the complainant by her husband and other in-laws due to non-fulfillment of demand of dowry and removing her from matrimonial house snatching her personal belongings.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.76737 of 2018(4) dt.01-07-2019 2/2 petitioner submits that petitioner is the husband of the complainant and he is working in the Indian Army as constable posted at Jammu and Kashmir. Further submission is that the matter was referred to Mediation Centre, Patna High Court, Patna for settlement of dispute between the parties, but due to rigid attitude of the complainant, the dispute between the parties could not be resolved. Further submission is that petitioner is paying maintenance to the complainant. On the other hand, learned counsel appearing on behalf of the complainant submits that complainant wants to live with the petitioner at Jammu and Kashmir.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Bhagalpur in connection with Complaint Case No. 2282 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
