====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-12-2020 Heard Mr. Birendra Kumar Singh, learned counsel for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State.

The petitioner seeks bail in connection with Nabinagar P.S. Case No. 309 of 2019 dated 24.11.2019 instituted for the offence under Section 25(1-B)a, 26 of the Arms Act.

It appears from the prosecution version that one country made pistol and two live cartridges have been recovered from his possession.

The petitioner is in custody since 25.11.2019. Learned counsel for the petitioner submits that though he has been made accused in about 27 cases but out of those 27 cases, he has been acquitted in 15 cases and is on bail in five other cases. Rest of the cases are

Patna High Court CR. MISC. No.25915 of 2020(3) dt.01-12-2020 2/2 of recent origin and has been thurst upon the petitioner because of some rivalry. The learned counsel for the petitioner further submits that there has not been any substantial progress in the trial.

Regard being had to the aforesaid facts especially the period of custody of the petitioner and stage of the case, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Nabinagar P.S. Case No. 309 of 2019.

The petitioner shall, however, participate in the trial and his absence from the trial proceedings would render his bail liable to be cancelled.
