The petitioner apprehends his arrest in Bairiya PS Case No. 257 of 2021 registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused Sibu Pandey assaulted the informant by bat on account of which hand of informant got fractured. It is submitted that petitioner has been falsely implicated in this case on account of land dispute. Both parties are agnates and due to land dispute the alleged occurrence took place in which both sides sustained injuries. Injuries sustained by the injured persons are not on the vital part of the body. Counsel for the State however vehemently opposed

Patna High Court CR. MISC. No.23754 of 2022(2) dt.08-09-2022 2/2 the prayer for bail and submitted that injuries attributed to this petitioner is grievous in nature and petitioner has five criminal antecedents.

Considering the nature of injury and criminal antecedents, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected.
