2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 188, 341, 342, 323, 332, 353, 283 and 504 of the Indian Penal Code and under Section 9 of the Bihar Control of the use and play of Loud Speaker Act.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant. It is submitted that as per the case of the prosecution,
Patna High Court CR. MISC. No.27225 of 2024(2) dt.19-07-2024 2/3 it is alleged that two groups of people were protesting on the road during voting for election of Mukhiya and were raising slogans and also tried to obstruct the informant from discharging his official duty.
Learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR it would manifest that the allegations are general and omnibus in nature and similarly situated co-accused Bashisht Narayan Jha along with two others had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 71009 of 2023 and the same was allowed by an order dated 28.11.2023 passed by a learned Co-ordinate Bench.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Rupees Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Benipatti
