JUSTICE ARUN KUMAR ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 341, 147, 149, 323, 307 of the Indian Penal Code.

Allegation in brief is that while the husband of the informant was returning back from market he was assaulted by the petitioner, his son and 8-10 unknown persons. Submission is that the informant is not the eye witness and there is no any apparent injury on the person of the informant's husband only injury as pain and swelling in back side is simple in nature though the allegation of assault is against 8-10 unknown persons. This petitioner has no criminal antecedent.

No.28967 of 2017 (2) dt.13-07-2017 2/2 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Buta Singh @ Buta Pandey be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad (Bihar) in connection with Amba P.S. Case No.39 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
