The petitioner apprehends his arrest in a case registered for the offence under Sections 457, 380 of the Indian Penal Code.
It is submitted on behalf of petitioner that petitioner has been made accused in this case on the basis of confessional statement of co-accused Nesar Alam, who was apprehended on spot. Save and except confessional statement of co-accused, there is no other material against this petitioner to show his complicity in the aforesaid crime. No stolen article has been recovered from the possession of this petitioner. Petitioner has got clean antecedent.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.23565 of 2023(2) dt.27-06-2023 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bettiah, West Champaran in connection with Srinagar P.S. Case No. 73 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
