JUSTICE SUDHIR SINGH ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 25 (1-b) a/26 of the Arms Act.

Allegation against the petitioner is that he was apprehended with fire arms.

It has been submitted on behalf of the petitioner that he is in custody since 28.1.2016. Charge has already been framed in the case. There is no allegation of tampering of witnesses against the petitioner. One loaded country made pistol along with one live cartridge is said to have been recovered from the possession of the petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. It is further submitted that petitioner may be released after completion of nine months in custody, i.e., from 28.1.2016.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of nine months in custody, i.e.., from 28.1.2016 on furnishing bail

Patna High Court Cr.Misc. No.28970 of 2016 (4) dt.31-08-2016 2/2 bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan Town P.S. Case no. 71 of 2016.
