The petitioner apprehends his arrest in connection with Complaint Case No. 961 of 2014 instituted under Sections 406, 417, 420, 467 and 468 of the Indian Penal Code. The allegation, in brief, is that petitioner mortgaged the land in faour of the complainant and has taken Rs. 3 lacs with a condition that if he does not return back money within a year, the land in question will be sold in favour of the complainant. After lapse of one year, neither money was returned back nor land was executed rather he sold the land to some other person. It is submitted that there is no any registered

Patna High Court Cr.Misc. No.29128 of 2017 (2) dt.13-07-2017 2/2 mortgaged with the complainant and the dispute is civil in nature and the petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, let the petitioner, namely, Dipti Singh, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur in connection with Complaint Case No. 961 of 2014; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
