The petitioner is apprehending his arrest in connection with Madanpur P.S. Case No.216 of 2018 registered for offences punishable under Section 366 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the daughter of the informant.
Submission of learned counsel for the petitioner is that FIR lodged against the petitioner. The statement under Section 164 Cr.P.C. has been recorded of the victim in which she has gone with the petitioner on her own will. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.1736 of 2019(2) dt.01-02-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt/ production of a copy of this order, be released on bail upon furnishing bail bond of Rs.25,000/-(Rupees Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No.216 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
