Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. Allegation against the petitioner is that she threw her 08 months old son into the Ganga river, causing his death. She has done so after quarreling with her husband. The husband of the petitioner is informant of the case. During trial, the husband has not supported the allegation against the petitioner, nor any other prosecution witness examined during trial has supported the allegation.

Earlier prayer for bail, by order dated 21.08.2018 in Criminal Miscellaneous No.35484 of 2018, vide Annexure 1 was refused. Petitioner is in custody since 03.02.2018. She is a

Considering the entire facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with S.Tr. No.622 of 2018, arising out of Danapur Police Station Case No.55 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
