JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2015 The petitioner being husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

The basic accusation is of torture.

In pursuance to the order dated 18.02.2015, whereby notices were issued to the complainant/O.P. No. 2 and interim order was passed staying further proceeding against the petitioner, the complainant/O.P. No. 2 appeared on 24.04.2015, however the petitioner chose not to appear. Hence, vide order dated 24.04.2015 the matter was adjourned for 11.05.2015. Today also the complainant/O.P. No. 2 is present but petitioner has not appeared.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.33784 of 2014 (4) dt.11-05-2015 2/2 petitioner that petitioner has been informed about the date fixed in the matter for today. It reflects that petitioner has no interest to pursue the matter.

Accordingly the application is dismissed in connection with Complaint Case No. C-898 of 2013, arising out of Trial No. 4538 of 2014, pending in the Court of learned Judicial Magistrate, 1st Class, Sikrahna at Motihari. (Dinesh Kumar Singh, J) Shageer/- U T
