The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 126 of 2017 registered for the offences punishable under Sections 448, 353, 504 and 34 of the Indian Penal Code.
Allegedly, the petitioner after snatching the files from the hands of the informant caused threats to work as per his choice otherwise to eliminate her and further abused in filthy languages.
Submission is of false implication and that the mother of the petitioner was Ward Councilor, due to that rivalry the petitioner has been implicated falsely, all allegations are concocted and baseless, the mother of the petitioner died, the petitioner without any fault is apprehending his arrest and as such he
Patna High Court Cr.Misc. No.26581 of 2017 (3) dt.13-07-2017 deserves sympathetic consideration.
Learned APP opposes the prayer of pre-arrest bail by submitting that the petitioner has got criminal antecedent also. In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna in connection with Bakhtiyarpur P.S. Case No. 126 of 2017, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
