JUSTICE ARUN KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 394 of the Indian Penal Code. Allegation in the F.I.R. is that three boys intercepted the informant on the way and robbed his motorcycle. F.I.R. is against unknown. The robbed motorcycle was recovered from one Shubham Singh and he has disclosed the name of the petitioner regarding his involvement in the present crime. Learned counsel for the petitioner submits that except the disclosure of name by co-accused, there is no other material against him. Another similarly situated co-accused Rajeev Kumar Paswan was granted bail by a Co-ordinate Bench of this Court. Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.29061 of 2017 (2) dt.01-07-2017 2/2 in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Rohit Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional Chief Judicial Magistrate, Samastipur in connection with Khanpur P.S. Case No.74 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
