The petitioner seeks bail in Kankarbag P.S. Case No. 872/2018, instituted for offence under Section(s) 290 of the Indian Penal Code read with Sections 3, 4, 5 and 6 of Prevention of Immoral Traffic Act.

Learned counsel for the petitioner has submitted that victim girl, Kavita Sarkar, has given statement under Section 164 Cr.P.C. Copy of aforesaid statement is annexed as Annexure-2, wherein she has not levelled any allegation of specific overt act against this petitioner.

It is alleged in the written report that police, on confidential information that sex racket is going on in a house in front of Jalpa Enclave at Ramlakhan Path, raided the house and

Aforesaid Kavita Sarkar told that she was brought in the house by Rubi Devi and Harendra Manjhi (Petitioner). She was forced to do illegal act but no illegal act has been done by her. Co-accused Ruby Devi has already been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 78614/2018 dated 18.01.2019.

Petitioner is in custody since 20.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna, in connection with Kankarbagh P.S. Case No. 872/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
