Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Akbarpur PS. Case No. 243 of 2020 for the offence punishable under Sections 302, 120-B of the Indian Penal Code. It has been submitted by learned counsel for the petitioner that the petitioner is serving in C.R.P.F. and there is no chance of his absconding.
Considering the aforesaid facts, this anticipatory bail application is allowed.
Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.23772 of 2022(2) dt.17-05-2022 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Akbarpur P.S. Case No. 243 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
While accepting the bail bonds of the petitioner, the Court below shall verify the Identity Card of the petitioner. If it is found that the petitioner is working in the C.R.P.F. then his bail bonds shall be accepted by the Court below. If it is found that the petitioner is not working in the C.R.P.F., in such a situation, the Court below shall not accept his bail bonds and he shall be taken into custody.
