====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------ 23-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Basantpur P.S. Case No.333 of 2014 registered under Sections 406, 420, 465, 467, 468 and 471/34 of the Indian Penal Code. The accusation against the petitioner is of committing cheat by representing himself to be Director of National Services Company and getting deposited Rs.2,65,000/- of the complainant/informant through agent Rajeshwar Prasad with assurance to return the said amount with high interest but the petitioner closed the Company.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.3840 of 2017 (2) dt.23-02-2017 submits that, in fact, the petitioner was an employee in the National Services Company but with an ulterior motive, the petitioner has been made accused in this case showing him as a Director of the said Company. The petitioner is in custody since 11.04.2016 and the chargesheet has been submitted against the petitioner in this case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Siwan, in connection with Basantpur P.S. Case No.333 of 2014.
