JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-04-2022 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No. 185 of 2019 registered for offence punishable under sections 143, 341, 342, 323, 307 and 302 of the Indian Penal Code.

The learned counsel for the petitioner has submitted that the case of the petitioner is also on the similar footing of co-accused Anukul Kumar @ Ankul Kumar, who has been granted regular bail by the coordinate Bench in Cr. Misc.

Patna High Court CR. MISC. No.34595 of 2021(2) dt.07-04-2022 2/2 No.28037 of 2020. Although, there is specific allegation on Ankul Kumar of pressing throat of deceased Golu Ram, but considering the fact that the cause of death of Golu Ram was not due to strangulation, rather it was due to chest injury, the coordinate Bench has granted him regular bail. Considering the above-mentioned facts and circumstances, the petitioner is directed to surrender before the court below and pray for regular bail. The court below, while considering the regular bail petition of this petitioner, shall take into account that on similar footing, co-accused Ankul Kumar has been granted regular bail.

With these observations, this criminal miscellaneous petition is being disposed of.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
