JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-11-2020 In view of the submission and the undertaking of the learned counsel for the petitioners, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 21.09.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Sahiyara P.S. Case no. 09 of 2020, registered under Sections 363 and 366(A) of the Indian Penal Code.

No.25520 of 2020(3) dt.12-11-2020 2/3 The accusation is that on 26.01.2020 at about 8.00 P.M., daughter of informant Rambabu Rai, aged about 11 years, moved from house to attend call of nature, but she did not return. Thereafter, informant Rambabu Rai started to search his daughter then he came to know that Rahul Kumar Thakur with the help of Jainandan Mahto, Pramila Devi (Petitioner No.1) and Punam Devi (Petitioner No.2) have kidnapped his daughter for the purpose of marriage or prostitution.

Learned counsel for the petitioners submits that, in fact, daughter of informant left village due to love affairs with Rahul Kumar Thakur, son of Pramila Devi (Petitioner No.1), but petitioners being the mother and sister-in-law (Bhabhi), respectively, of Rahul Kumar Thakur have falsely been implicated in this case. Further submission is that both the petitioners are ladies.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sahiyara P.S. Case No.
