The learned counsel for the petitioner very fairly, at the outset, submits that inadvertently, the present bail application has been filed when the liberty was granted to the petitioner to move before this Court renewing his bail after framing of charge.

The learned counsel for the petitioner submits that the charges till date have not been framed.

Considering the submission made by the learned counsel for the petitioner, the bail application is permitted to be withdrawn.

The liberty as granted by order dated 04.01.2023 in Cr. Misc. No.54090 of 2022 shall remain in existence i.e. the

Patna High Court CR. MISC. No.23539 of 2023(2) dt.12-04-2023 2/2 petitioner shall be at liberty to renew his prayer for bail after framing of charge.
