JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioners are named in the first information report and no specific overt-act has been attributed against the petitioners in the F.I.R. but when the statements of witnesses were recorded, the witnesses stated that petitioners and two others caught hold the deceased whereas F.I.R. named accused, Prahlad Kumar as well as Dinesh Kewat opened fire on the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact

No.27660 of 2016 (3) dt.17-09-2016 2/2 that investigation against these petitioners has already been completed, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Depak Kumar, Judicial Magistrate 1st Class, Barh in connection with Maranchi P.S. Case No. 113 of 2015.
