This application for regular bail arises out of Ahiyapur P.S. Case No. 931 of 2019, disclosing offences punishable under Sections 399, 402, 414/411 of the Indian Penal Code and Section 20/22 of the NDPS Act and Section 25(1-b)a 26, 35 of the Arms Act.

The petitioner is in custody since 08.08.2019. His prayer for regular bail was earlier rejected twice by orders dated 16.03.2020 and 22.09.2021 passed in Cr. Miscellaneous No. 76424 of 2019 and Cr. Miscellaneous No. 4153 of 2021 respectively. While rejecting the petitioner's prayer for bail by order dated 22.09.2021, he was given liberty to renew his prayer

Patna High Court CR. MISC. No.23884 of 2022(7) dt.18-01-2023 2/3 for bail after six months, if there was no substantial progress at the trial. In view of the said observation made by this Court, present application has been filed renewing the prayer for bail. Earlier when the matter was taken up on 14.12.2022, a report was called for from the court below as regards present stage of trial in connection with Ahiyapur P.S. Case No. 931 of 2019. A report has accordingly been submitted from which it transpires that despite reminders to the Senior Superintendent of Police, Muzaffarpur, no prosecution witness has been produced after 01.09.2022 and only three witnesses out of ten have so far been examined.

Learned counsel for the petitioner has submitted that other accused persons have been granted bail under various orders of this Court.

Considering the facts and circumstances, particularly, the fact that there is no satisfactory progress at the trial, in my opinion, a case is made out for directing release of the petitioner on bail.

Considering the above, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount, each to the satisfaction of learned 1st Additional
