The petitioner is languishing in custody since 11.08.2018 in a case registered for the offences punishable under sections 25(1-B)a, 26, 35 of the Arms Act. The prosecution case got initiated on the basis of written report dated 09.08.2018 submitted by Nawal Kishore Yadav to the Station House Officer, Taraiya Police Station to the effect that on 09.08.2018 when the informant was on patrolling duty, the SHO informed him through mobile phone that the villagers have apprehended a criminal at Village Maulanapur. On having received such information, the informant along with other police party reached at the spot where the villagers handed over the custody of the
Patna High Court Cr.Misc. No.1773 of 2019(2) dt.15-01-2019 2/2 apprehended person, to them. On frisking, a loaded country made pistol and a live cartridge were recovered from the possession of the apprehended accused person. It is submitted by learned counsel for the petitioner that the petitioner was an employee of the brick-kiln of Bijendra Manjhi and in the background of dispute with regard to wages, one Bijendra Manjhi got the petitioner implicated in the present case and also in another case being Taraiya P.S. Case No. 220 of 2018, in which he is on bail. Learned APP for the State submits that the recovery of arms has been made from the possession of the petitioner. Considering the period of custody of the petitioner, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IX, Saran, in connection with Taraiya P.S. Case No.221 of 2018.
