JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307 & other minor sections of the Indian Penal Code. Petitioner is said to have given Khanti blow, causing grievous injury to informant's wife and taking note of the aforesaid fact, this court earlier rejected the prayer for bail of the petitioner vide order dated 25-01-2016 passed in Cr. Misc. 2156 of 2016 but submission on behalf of petitioner is that the petitioner is languishing in jail custody since 21-09-2015 but uptll now, only charge could be framed against the petitioner. Considering the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to release the
Patna High Court Cr.Misc. No.26942 of 2016 (2) dt.17-08-2016 2/2 petitioner on bail and accordingly, his prayer for bail in connection with Siwan Muffasil P.S. Case No. 246 of 2015 corresponding to Sessions Trial No. 186 of 2016 pending in the court of Learned Additional Sessions Judge-II, Siwan is, again rejected. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within four months from the date of receipt/production of copy of this order, failing which, the petitioner shall be at liberty to renew his prayer for bail before the learned court below itself.
