Learned counsel for the petitioner undertakes to remove the defects within four weeks of normal court proceedings. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner apprehends his arrest in Complaint Case No.151(C)/2007, registered for the offences punishable under Sections 304(B) and 201 of the Indian Penal Code. The petitioner and his father are said to have doused complainant's daughter with kerosene oil and set her on fire for non-fulfillment of demand of motorcycle and colour TV as

Patna High Court CR. MISC. No.32382 of 2021(2) dt.27-01-2022 2/3 dowry. It is further alleged that marriage of complainant's daughter was solemnized with the petitioner in the year 2004 and she died on 22.02.2007.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the occurrence took place on 05.02.2007. Thereafter the deceased was treated by the petitioner and his family members. On 22.02.2007, the daughter of the complainant died. Thereafter the complaint was filed on 23.02.2002 against the petitioner. Learned counsel for the petitioner submits that a UD case was also registered in which police submitted final report. It is further submitted that cognizance was taken on 17.01.2020 after lapse of 13 years. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.

Taking into consideration the facts foresaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur in connection with Complaint
