JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner and the State.

Petitioner being the husband of the informant is languishing in custody since 03.03.2016 in a case registered for the offences punishable under Sections 342, 323, 325, 307, 498A/34 of the Indian Penal Code. The basic accusation is of torture and making assault.

It is submitted by the learned counsel for the petitioner that from First Information Report it appears that no injury has been caused to the informant. Petitioner admits the marriage with the informant and birth of two children. The petitioner is still ready to keep the informant as wife with full dignity and honour. Statement to that effect has been made in para-8 of the petition which reads as

Patna High Court Cr.Misc. No.27299 of 2016 (3) dt.11-07-2016 follows:- "That the petitioner, who happen to be husband of the informant, is still ready to resume the conjugal life and to keep the informant with all honour, affection and dignity and same pleading has been advanced before the learned court below."

Moreover the investigation has now concluded. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Araria in connection with Araria (Mahila) P.S. Case No. 10 of 2016.
