====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bidupur P.S. Case No. 473 of 2015, instituted for the offence under Section(s) 376 of the Indian Penal Code.

Counsel for the petitioner submits that the instant case is counter blast of Complaint Case No. 2480 of 2015 filed by mother of the petitioner namely Meena Devi against the informant and her family members. The informant earlier had also filed Complaint Case No. 2539 of 2015 which is mentioned in the present case.

It is alleged in the written report that on the date of occurrence, petitioner entered into the room which was locked from inside and on the point of pistol, he committed rape with

Patna High Court Cr.Misc. No.76848 of 2018(2) dt.21-02-2019 2/2 her. There is delay of three days in lodging the First Information Report and no explanation has been given in the written report.

Petitioner is custody since 28.8.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 473 of 2015,subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
