JUSTICE RAMESH KUMAR DATTA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioners and learned Additional P.P. for the State.

The petitioners pray for anticipatory bail in a case under Sections 149, 323, 427, 504, 338, 379 and 308 of the Indian Penal Code.

It is submitted by learned counsel for the petitioners that the petitioners are next-door neighbours of the informant and they are on inimical term and for the said reason they have been falsely implicated. It is further submitted that the injuries found on the informant and his brother are simple in nature and could have been created. It is also submitted that the petitioners have no criminal antecedent.

Patna High Court Cr.Misc. No.46857 of 2015 (2) dt.16-10-2015 On a consideration of the facts and circumstances of the case, it is directed that the petitioners, namely, (1) Jai Prakash Yadav @ J.P.Yadav and (2) Juli Kumar, in the event of their arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Patliputra P.S.Case No.155 of 2015 to the satisfaction of Shri Sushant Ranjan, Judicial Magistrate, 1st Class, Patna, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
