JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Jehanabad P.S. Case No. 287 of 2007 registered under Sections 420, 467, 468, 470, 471 and 120(B) of the Indian Penal Code. The accusation is that brother of the informant, Ashok Kumar, purchased one SIM from the shop, namely, New Mobile Care, of Amir Mian. Subsequently, it was detected that nine SIMs have already been issued in the name of brother of informant. Thereafter, informant submitted an application to close the said SIMs but later on, came to know that two SIMs is still inactivation.

Patna High Court Cr.Misc. No.47184 of 2015 (2) dt.16-10-2015 Learned counsel for the petitioner submits that petitioner happens to be brother of the informant while his name has come in course of investigation and police submitted charge sheet against Abu Hanzala by submitting final form but cognizance of offence has also been taken against him. Further submission is that petitioner has no criminal antecedent. Considering the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Jehanabad, in connection with Jehanabad P.S. Case No. 287 of 2007, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
