JUSTICE SUDHIR SINGH ORAL ORDER 30-08-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 147, 148, 149, 307, 324, 384, 386, 302 and 379 of the Indian Penal Code and 27 of the Arms Act.
Prosecution case is that while the informant was checking the truck at Mahadev Enclave Pvt. Ltd., the accused persons came and started firing, as a result of which four persons sustained fire arm injuries and the accused persons looted away Rs.4 lcs, mobile and the challan book. In course of treatment two injured persons had died.
It has been submitted on behalf of the petitioners that they are in custody since 25.11.2015. Chargesheet has been submitted against the petitioners. There is no allegation of tampering of witnesses against the petitioners. Petitioners are not named in the F.I.R. Their names have come on the confessional statement of the co-accused. Except for that there is no other material to suggest their implication in the present case. On behalf of the State, it is submitted that petitioners are not named in the F.I.R.

No.28792 of 2016 (4) dt.30-08-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Banka, in connection with S.T. no. 66 of 2016/T.R. no. 451 of 2016 arising out of Amarpur P.S. Case no. 215 of 2015.
