JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Khushrupur P.S. Case No. 13 of 2020 registered for the offences under Sections 307, 323, 341, 324, 34 of the Indian Penal Code and Section 27 of the Arms Act. In the instant case, the allegation against the petitioner is that he fired at the informant which caused injury on the hand of the informant.

Learned counsel appearing on behalf of the petitioner would refer to Annexure-2 to contend that there is case and counter case and the case filed by the

Patna High Court CR. MISC. No.23463 of 2020(4) dt.19-02-2021 2/2 petitioner is at earlier point of time. He further submits that the nature of injury is superficial and as such Section 307 I.P.C is not attracted.

Considering the fact that there is case and counter case and the case filed by the petitioner is at earlier point of time, this Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 50,000/- (Rupees fifty thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City, Patna in connection with Khushrupur P.S. Case No. 13 of 2020.
