The petitioner apprehends his arrest in Baisi P.S. Case No. 202 of 2015 registered for the offences punishable under Section 7 of the Essential Commodities Act.
The tractor loaded with 91.50 quintals rice was recovered and the informant alleged that the petitioner is the owner of the tractor.
Learned counsel for the petitioner submits that from perusal of Annexure-2, it would appear that the tractor was registered in the name of Golam Gosh. The petitioner was not the owner of the tractor. Golam Gosh filed petition for release of the tractor in the court below.
Considering the facts aforesaid the petitioner above
Patna High Court Cr.Misc. No.27230 of 2017 (3) dt.20-07-2017 named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Purnea in Baisi P.S.
