1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code and under Section 3 /4 of the Dowry Prohibition Act.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and being motherin-law of the deceased has been falsely implicated in the present case.
4. The informant alleges that his sister was married to Akash Kumar Pandit on 14.05.2022 and after marriage the accused persons including the petitioner were demanding Rs. 75,000/- but for non-fulfillment of the demand, the victim was
Patna High Court CR. MISC. No.23381 of 2023(2) dt.13-07-2023 2/3 tortured, it is next alleged that due to non-fulfillment of dowry demand, his sister was killed by the accused persons.
5. Learned counsel for the petitioner next submits that the petitioner has been falsely implicated in the present case, it is next submitted that the husband of the deceased was working in a Mines in Andhra Pradesh and the deceased wanted to accompany her husband to his place of posting, but the husband was not willing to take her, as the nature of work which he was performing was dangerous, this led to a serious altercation and the deceased in a fit of rage committed suicide. It is next submitted that no specific allegation of demand and torture is alleged against the petitioner. It is next submitted that Akash Kumar Pandit is also availing his remedies available in law.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case
