Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-04-2022 Heard Mr. Pushkar Narain Shahi, learned senior advocate for the petitioner and learned Additional Public Prosecutor representing the State.

The petitioner seeks bail in anticipation of his arrest in connection with Kudra P.S. Case No. 247 of 2020 dated 13.08.2020 instituted for the offences under Sections 409, 240, 467, 468, 471 of the Indian Penal Code.

The petitioner is alleged to have obtained employment as an X-ray Technician in the Primary Health Center, Kudra on the basis of forged certificate.

The petitioner denies such accusation and submits that he is presently employed as X-ray Technician in N.M.C.H. and not in Primary Health Center, Kudra as has been alleged. He has further submitted that there could be some confusion with

Patna High Court CR. MISC. No.33985 of 2021(3) dt.29-04-2022 2/2 respect to his identity for the reason that the date of birth in the document of the accused person shown in the F.I.R. is different from the date of birth of the petitioner.

The learned counsel for the petitioner has further submitted that the petitioner has been discharging his duty to the best of his ability in N.M.C.H., which appointment has not been challenged in any forum whatsoever.

Considering the aforenoted submissions on behalf of the petitioner, the provisional bail granted to him vide order dated 20.01.2022 is hereby confirmed.

The petitioner shall remain on the same bail bonds. The application stands allowed accordingly.
