JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Deep Nagar P.S. Case No. 136 of 2018 for the offence under Section 377 of the Indian Penal Code and Sections 4/8 of the POCSO Act.
Considering the nature of allegation and the age of the victim, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for grant of bail is rejected. However, the court below is directed to expedite the trial on priority basis and conclude the same within a period of nine months from the date of receipt of a copy of this order.
