Petitioner is languishing in custody in connection with Kotwali (Gaya) P.S. Case No. 346 of 2016 for the offences punishable under Sections 17/18/21/22 of the N.D.P.S. Act. Hundred small packets of heroin was recovered from the pocket of this petitioner and the petitioner is in custody since 12.10.2016.
Submission is that the petitioner has got no criminal antecedent and the recovered quantity was just above the small quantity.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. The
Patna High Court Cr.Misc. No.51015 of 2016 (3) dt.30-01-2017 2/2 bail prayer of the petitioner is refused. If the trial is not concluded within nine months from today, the petitioner may renew the prayer for bail before the learned Court-below. (Birendra Kumar, J) Mkr./- U T
