JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bairgini P.S. Case No. 125 of 2013 registered under Sections 363, 366A and 372/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. and his name has transpired during the course of investigation mere on suspicion. Moreso, the statement of victim, Tripti Arya, is recorded under section 164 of the Cr. P.C., in which she has stated about performing the marriage with one Monu Kumar and she has not stated anything against the petitioner. Monu Kumar has already been allowed anticipatory bail by a Bench of this Court vide Cr. Misc. No. 32486 of 2014 on 06.02.2015.

No.46927 of 2015 (3) dt.11-02-2016 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Sitamarhi in connection with Bairgini P.S. Case No. 125 of 2013 subject to the condition as laid down under Section 438(2) of the Cr. P.C.
